Terms and conditions of purchase
These terms govern access to contracting and the purchase of products through bijuymoda.com. Unless expressly stated otherwise in a specific offer, the website is mainly aimed at wholesale, professional, resale and export operations.

2. Purpose and scope
These terms govern the offer, request, acceptance, sale, payment, dispatch, delivery, incidents, cancellations and, where applicable, returns of products marketed through this website or through sales channels linked to Bijuymoda.
Any specific conditions included in a product page, offer, lot, quotation, proforma invoice, order confirmation or commercial communication accepted by the parties shall complement these terms and shall prevail insofar as they specifically apply to the transaction.
If, exceptionally, a transaction is subject to different mandatory regulations due to the status of the buyer or the nature of the sale, such regulations shall prevail to the extent strictly required.
3. Customer, language and acceptance of the terms
By placing an order, the customer declares that the information provided is correct, complete and up to date, and that they have sufficient legal capacity to contract.
The contract is formalized in Spanish. Any versions published in other languages on the website are for information purposes only unless expressly stated otherwise.
Placing an order through the website, email, messaging, telephone or any other channel enabled by Bijuymoda implies acceptance of these terms and, where applicable, of the specific conditions of the relevant offer or lot.
4. Order request and conclusion of the sale
Adding products to the cart, sending a request through the website or requesting a quotation does not by itself imply final acceptance of the order by Bijuymoda.
The transaction shall be deemed accepted when any of the following occurs, depending on the type of sale:
- express confirmation of the order by Bijuymoda;
- issue and acceptance of a quotation or proforma invoice;
- receipt of full or partial payment where indicated for the transaction;
- the start of specific preparation, stock reservation, packing list, export documentation or dispatch of the goods.
Electronic records, emails, proof of payment, proforma invoices, confirmations and any other media used in the contracting process shall serve as evidence of the transaction.
5. Products, lots and availability
All orders are subject to stock availability. The publication of a product or lot on the website does not guarantee final availability until the order has been accepted.
Images, descriptions, categories, references, approximate units, weights, measurements, conditions, classifications and any other published details are for guidance or commercial information purposes, unless expressly stated as a fixed condition of the offer.
For products in special offer, liquidation, clearance, bazaar, overstocks, returns, marketplace goods or mixed lots, content may vary and presentation or condition may depend on the specific lot. Where applicable, a lot may include units in different conditions or grades, including Grade A and some Grade B or C units, depending on the lot, without item-by-item inspection unless expressly stated in the offer.
Unless expressly stated otherwise, lots are sold in their current condition and with the general characteristics indicated in the relevant offer.
6. Prices, taxes and costs
Unless expressly stated otherwise, published prices are understood not to include shipping costs, special transport, extraordinary handling, storage, documentary procedures, customs, duties, destination taxes or any other ancillary costs.
The VAT rate or applicable tax treatment shall be the one in force at the relevant time according to the product, destination and the customer’s tax status.
In transactions subject to the retail equivalence surcharge, the customer must inform Bijuymoda when placing the order or before invoicing so that the appropriate tax treatment may be applied.
For intra-community transactions, any exemption shall be subject to the customer providing a valid VAT number and to the transaction meeting the applicable legal and formal requirements.
For exports outside the European Union and shipments to the Canary Islands, Ceuta and Melilla, taxes, duties, customs clearance, import charges, storage, destination expenses, delays and any similar costs shall be borne by the customer unless otherwise agreed in writing.
Unless otherwise stated in a specific offer, there is a minimum purchase of €100, taxes not included. There is no maximum purchase and availability shall depend on stock and order acceptance.
7. Payment methods
Unless another payment method is indicated for a specific transaction, payment may be made by bank card, PayPal or bank transfer.
Payments shall be made in euros unless expressly agreed otherwise.
For orders subject to advance payment, the goods shall not be dispatched until full payment has been confirmed, unless otherwise agreed in writing.
If a payment transaction is rejected, revoked, not completed correctly or cannot be verified, Bijuymoda may suspend or cancel the order.
8. Shipping, transit, delivery and receipt
The goods shall be sent to the address provided by the customer. It is the customer’s responsibility to ensure that delivery details, contact information, timetable and receiving arrangements are correct.
Transit and delivery times are indicative and may vary due to volume, weight, destination, carrier, peak seasons, logistics incidents, customs controls, documentation or any other circumstances beyond Bijuymoda’s control.
- Mainland Spain: approximately 24 to 72 working hours.
- Balearic Islands, Canary Islands, Ceuta and Melilla: approximately up to 7 working days.
- Europe: approximately 7 to 10 working days.
- Special or sea shipments: depending on route, volume and documentation of the transaction.
Where required by the nature of the goods, the customer must have sufficient staff, unloading equipment, machinery or access conditions to receive the order properly.
Delivery shall be deemed completed when the goods are made available to the customer or to a third party designated by the customer at the address indicated for delivery, without prejudice to the corresponding documentary or logistics evidence.
9. Failure of delivery, non-receipt or failure to unload
If delivery cannot be completed for reasons attributable to the customer, including absence, incorrect details, lack of access, unjustified refusal, lack of unloading means or failure to collect in time, Bijuymoda may arrange a new delivery attempt where possible.
Any costs arising from a second delivery attempt, storage, immobilization, return, reshipment, document handling, deposit, customs, delay, extraordinary handling or any equivalent incident shall be borne by the customer where the cause is attributable to them.
If, after a reasonable new attempt or sufficient availability for collection, the goods are not received or unloaded for reasons attributable to the customer, Bijuymoda may consider the buyer’s duty to take delivery as breached and adopt the measures it deems appropriate for the preservation, return, deposit, termination or reshipment of the goods, without entitlement to reimbursement of costs already incurred.
10. Transport incidents, shortages and defective products
The customer must inspect the goods upon receipt and report without delay any apparent incident.
In the event of visible transport damage, damaged packaging, knocks, breakages, missing packages or externally detectable delivery incidents, the customer must record the issue with the carrier and notify Bijuymoda in writing, wherever possible, within 48 hours of delivery, providing photographs or any available documentation.
Claims for apparent defects in quantity or quality in commercial transactions must be submitted in writing without delay and, where applicable, within the legally applicable time limits.
In the event of defective products or internal incidents not apparent upon receipt, the customer must notify Bijuymoda in writing and provide the necessary information for assessment.
Once the incident has been verified, Bijuymoda may propose, depending on the case, replacement, substitution, partial credit, refund of the affected amount or any other appropriate commercial solution.
11. Order cancellation
The customer may request cancellation of an order before specific preparation, stock reservation, issuance of binding documentation, packing list, customs handling or dispatch has begun.
For standard orders, cancellation requests must be communicated as early as possible and, in any case, before the actual dispatch of the goods.
For special offers, liquidation lots, special lots, reserved goods, tailor-prepared orders, import, export or transactions with logistics already started, cancellation may not be possible or may generate associated costs to be borne by the customer.
A cancellation request alone does not imply its automatic acceptance by Bijuymoda.
12. Returns and exchanges
No returns or exchanges shall be accepted without Bijuymoda’s prior express written authorization.
For products or lots in special offer, liquidation, clearance, bazaar, overstocks, returns, goods sold as seen or lots with special conditions, returns and exchanges are not accepted, except in the event of an accredited error in the offer or order preparation, a duly reported transport incident, a substantial mismatch with the offer, or where a claim is applicable under mandatory law.
No returns sent at the customer’s initiative shall be accepted without prior communication, written authorization or compliance with the instructions provided by Bijuymoda.
In exceptional cases where a return or exchange is authorized for reasons not attributable to Bijuymoda, transport, return, handling and management costs shall be borne by the customer.
13. Exports and international operations
In international transactions, the customer must provide the tax, customs, logistics and documentary information required for the proper preparation and dispatch of the order.
The acceptance of a proforma invoice, full or partial payment, sending proof of transfer, issuance of a packing list, specific preparation of the order or the start of certificates or export documents implies final acceptance of the transaction under the communicated terms.
From the moment any of the above actions begins, cancellations, modifications, returns or refunds shall not be accepted in export transactions, special lots or goods prepared for international dispatch, except in the event of an error attributable to Bijuymoda or mandatory legal provision to the contrary.
All duties, taxes, destination charges, import costs, storage, delays, customs incidents, costs arising from failure to collect, returns at the border or equivalent expenses shall be borne exclusively by the customer unless otherwise agreed in writing.
If the customer fails to pay for international transport or does not meet the necessary requirements for dispatch or import of the goods, Bijuymoda may suspend the transaction, pass on the costs incurred or require the customer to arrange collection by their own means within the period communicated to them.
14. Personal data protection
The processing of personal data provided during the purchase process is governed by the Privacy Policy available on this website.
15. Modification of the terms
Bijuymoda may update or modify these terms at any time. For each transaction, the version in force on the date of acceptance of the order or of the relevant specific condition shall apply.
16. Applicable law and jurisdiction
These terms shall be governed by Spanish law.
For any dispute arising from the interpretation, validity, performance or fulfilment of these terms, the parties submit, where legally permitted, to the Courts and Tribunals of Málaga, expressly waiving any other jurisdiction that may correspond to them.
